Since it was not a HCPO, the warranty lapsed and you are out of warranty coverage. This means, you are responsible for all repairs. What I would do is do your best to work with your sales manager at the dealership and see how far you can get.

Read the emissions warranty for the state of California. Many of the emission parts are covered for a period longer than the 3 year 36000 mile bumper to bumper. The emission warranty is based on states so you need to check for your state. Make sure you check the 2016 warranty as it appears the newer models may have an even longer warranty.
California has one of the longest emission warranties so I would check that out. Other than a loose fuel cap (which these don't have) here are some things that could be defective according to this link.
