seems as it turns on when i am driving more than 40MPH
however.... in my neighborhood, the allowed speed is 35. we do not have any lights and I need this capability to be turned on when driving less than 40MPH.

can this be done?

What year and trim model?
So you can't just turn on your lights when you want to?

Welcome to the forum.

I am curious too . . . why not just turn the headlights on manually when you need them?

What does the user manual say regarding auto beam?

Making random assumption of year 2020, and checking the owner manual, page 180.
When auto-high-beam is on, car automatically will switch to high beams when speed is over 45mph, and other condition are met (i.e. no preceding/oncoming vehicles)
And will automatically switch back to low beams when below 30mph or a car ahead is detected
Are you absolutely certain your lights are actually off and not in low mode? Cause when you are in low beams and high beams come on, it may seem as if your lights were off.
